INNOVATE MEDIA ADVERTISING BOOKING TERMS AND CONDITIONS

SUBMISSION AND PUBLICATION OF ADVERTISEMENT

The advertiser should supply artwork to reach Innovate media by the stated artwork deadline in a PDF, Jpeg or Tiff file. Innovate Media reserves the right to charge for production work and any other additional work that Innovate Media may be required to undertake. 

In the event of any Advertisement not being received by the Copy Deadline, Innovate Media reserves the right to repeat the copy last used. In such event Innovate Media shall not be responsible for making any changes in that copy, unless these are confirmed in writing and in time for the changes to be made. Innovate Media reserves the right to charge for any additional expense involved in such changes.

Innovate Media will continue to use the artwork previous provided or agreed by the client into all advertisements booked by the advertiser unless otherwise informed in writing to run or await new artwork.

PROOFS

Innovate Media will submit proofs to the customer for approval. Innovate Media shall incur no liability for any errors not corrected by customers.

COPYRIGHT
The customer shall be responsible for obtaining the necessary authority to reproduce artwork, pictures, photographs and any other material used in their advert or article.

ADVERT POSISTIONING

Except as otherwise specifically agreed in writing by Innovate Media, the positioning and placement of Advertisements in the Advertising Space shall be treated as requests only and cannot be guaranteed.

PAYMENT
Customers must make full payment for the advert at the agreed price prior to going to print. Failure to do so may mean the advert/article/editorial is not printed or the flyers not delivered within the booked edition of Your Local Magazines. For adverts or flyer delivery cancelled within 30 days of the booking deadline no refund will be made. The balance of payments must be paid by the issues pre-payment deadline.

LATE PAYMENT/FAILURE TO PAY
Invoices not settled within 30 days of due date will be subject to legal proceedings and will incur additional costs.

DISCOUNTS
In the event of late payment, Innovate Media reserves the right to waive any agreed discounts.

CANCELLATION

Innovate Media may (at its sole discretion) change the date, suspend or cancel a Booking at any time for any reason without incurring any liability to You.

If you wish to cancel a booking you shall notify Innovate Media in writing, and you will be required to give a minimum of 30 days’ notice before the stated booking deadline for each publication.

Any cancellation received with less than 30 days’ notice will be subject to full payment

Innovate Media shall be under no obligation to reimburse all or part of such charges, even if Innovate Media resells the cancelled Advertising Space after such cancellation by the advertiser.

TERMINATION

Innovate Media shall have the right to terminate any Booking and/or any agreement between Innovate Media and the advertiser if you fail to make any payment by the due date or breach any of the terms and conditions.

FULL COLOUR PRINTING
While every effort will be made to obtain the best colour reproduction on customers work, because of the nature of the processes involved Innovate Media cannot guarantee an exact match in colour between submitted artwork and the printed advert/editorial/copy.

QUALITY
Every effort will be made to obtain the best reproduction of the customers advert, the quality of adverts which contain submitted artwork/images is not the responsibility of Innovate Media.

FORCE MAJEURE
Innovate Media shall be under no liability if they shall be unable to carry out any provision of the contract for any reason beyond their control including (without limiting the foregoing)Act of God, legislation, war, fire, flood, drought, failure of power supply, lockout, strike or other action taken by employees in contemplation of a dispute or owing to any inability to procure materials required for the performance of the contract. During the continuance of such a contingency Innovate Media may by written notice to the customer elect to terminate the contract and pay for work done and materials used up to and including the day of notice.

ILLEGAL MATTER
Innovate Media shall not be required to print any matter which in their opinion is or may be of an illegal or libellous nature or an infringement of the proprietary or other rights of any third party.

Innovate Media shall be fully indemnified by the customer in respect of any claims, costs and expenses whatsoever arising out of any libellous matter or any infringement of copyright, patent, design or of any other proprietary or person
